2007 TERMS & CONDITIONS (RENTAL AGREEMENT) FOR YOUR INFORMATION
LOVE NEST BY THE SEA – Condo is located in North Kihei, just N. of “Maui Lu” Hotel, at 483 S. Kihei Rd, at the Southern end of Sugar Beach.
Check-In: on arrival date is 3pm or later, and check-out on departure date is 10am or earlier. At check-out, please put all perishables and food items in the refrigerator, turn off all lights/fans, close all windows and louvers, and place all trash in the outdoor trash cans. Please recycle your glass and newspaper. Please lock all doors and leave keys inside. If your unit has a lockbox, please be certain that the entry key is in the lock box before you lock the door on your departure from the condo.
Use of Property: This condo is in a quiet, residential area. Parties or group entertaining are NOT permitted, and can be grounds for eviction. No commercial use of the property is permitted. Use of pool and spa are for guests only. Please rinse off all sand from body and remove shoes upon entry to condo, in compliance with traditional Hawaiian etiquette.
Proximity to Beach: This condo complex is less than 30 feet from the ocean, but there is a narrow 2 lane residential road between the sand and the condo complex. The actual distance of our condo unit from the beach is less than 300 feet and takes less than a minute to reach. Although our condo is not officially categorized as a beachfront condo, which is reflected in the lower nightly rental cost, it is actually located closer to the beach than many condos categorized as beachfront.
Minimum Stay: There is currently a 3 night minimum stay at the condo and no maximum stay. 3 and 4 night stays require an additional $95 cleaning fee. Stays 5 nights and over include the cleaning fee in the rental costs.
Guests: Use of property is limited to 6 adults, but recommended for only 4. Occasional, quiet guests are permitted, however, it is not intended that the condo be used as a “meeting place” for extra friends or family. Any guests MUST be accompanied by the Tenant ONLY. Please remember to observe quiet time (from 8pm to 8am) – the neighbors have filed complaints with county and police against violators. You are in a peaceful, residential neighborhood, and we ask that you and your children respect your neighbor’s privacy, peace and quiet.
Parking: A single car can be parked in the paved lot, in space #72. Any visitors may park in the designated parking stalls marked “guest,” or in the gravel lot at the front of the building. Parking in any other spot, or blocking access or driveways is not permitted.
Included Services: Property management or owner will provide the following: Yard care, water, electricity, telephone (excluding long distance), refuse disposal and recycling bins.
Additional Charges: Rates do NOT include daily maid service, excessive cleaning upon departure (i.e. Upholstery or carpet shampooing, etc.), or Hawaii State Transient Accommodations tax, currently at 11.42%. Housekeeping, maid service, cooks, or any other service requested or initiated by the Tenant shall be paid for by Tenant and not be the responsibility of the Owner, Manager or Agent.
Out-Cleaning Charges: For 5+ night stays, the out-cleaning charge is included in the rent, based on the understanding that Tenants will leave the unit clean and tidy at departure, including kitchen, bathrooms, laundry area, in the condition that they found it on arrival. Any extraordinary cleaning or laundry resulting from a guests’ visit (including smoke-smell removal) will be deducted from any cash security deposits, or charged to the credit card authorized, below. Tenant agrees to keep the premises in a clean and sanitary condition, to exercise care, regarding all furnishings and household items and to make no improvements or alterations. Tenant is advised NOT to move furniture, and NOT to take furniture cushions outside. BBQ must be left clean.
Damages/Repairs: Please notify us, immediately, of any damages to the condo. Owner/Manager reserves the right to enter the unit to inspect, make repairs or provide supplies. This right will not be abused and the owner will make every effort to give the Tenant twenty-four hours notice. Appliances, television, BBQ, , etc., are not guaranteed, and refunds will not be given due to the breakdown. Repairs shall be made as quickly as possible, and with as little inconvenience to the Tenant as possible.
No smoking: This is strictly a “NO SMOKING” rental. No smoking allowed inside the condo, or outside on the lanai, even with the sliding door closed. If the cleaning crew or manager determines that the condo was smoked in, which is obvious to non-smokers, tenant's full cleaning deposit will be forfeited, as the deposit will be used towards the removal of the smoke smell.
Rubbish Disposal: Please remove trash from the house at least daily and place in the outdoor trash bin, which is located at the front of the building, at the entrance, behind a cement wall. Keep all food inside the refrigerator, and throw out all food waste, asap, to avoid attracting ants and roaches. Tenant is responsible for excessive garbage, boxes or containers from shopping trips.
Supplies: A starter pack of paper goods and soap will be provided. Unlike a hotel, we do not replenish these supplies, and you are responsible for your own supplies, during your stay.
Energy Conservation: PLEASE be energy considerate. Energy in Hawaii is very expensive - in fact, Maui has the highest electricity costs in the nation. Please turn off a/c, lights, fans, TV, stereo, etc., whenever you will be out of the house for more than 15 minutes. Run the a/c only long enough to cool the condo to your liking, then shut it off. Energy consumption above 115% of normal usage will result in charges being deducted from your security deposit to cover the overage.
Telephone Calls: Unlimited local (Maui) phone calls are included. Please charge all your off-island calls to your credit card, calling card, or home number, as there is no long distance service in the condo.
Wireless High-Speed Internet Service: An optional, unlimited, 24-hour, high-speed wireless (works using cellular technology in most Maui areas) internet access service is available for $10 per day, plus tax. There is a 5 day minimum for this service. A $150 security deposit is required and will be charged to your card to replace a damaged or lost modem.
Keys: There is a $50 per key charge for keys not returned.
Loss/Theft: Tenant acknowledges that the home, including sliding doors and windows, should be locked, whenever Tenant is away from the condo. All windows/doors should be locked at night. The owner, agent or managers are NOT responsible for any loss of guest’s property as a result of theft or other damage caused by unauthorized entry into the unit.
Cancellations and Refunds: Cancellation of this reservation may result in a Cancellation Fee. If cancellation occurs PRIOR to 60 days before arrival, the cancellation fee will be $200. If cancellation occurs WITHIN 60 days before arrival, all rental payments will be forfeited, unless the space is re-rented, in which case you will be refunded your money, minus a $200 Cancellation Fee, within a 90 day period. Owner reserves the right to cancel this reservation should the property be removed from the vacation rental market. If this occurs, either a full refund (minus 11.42% HI State accommodations tax) will be immediately issued, or, if you prefer, we will make every effort to re-locate you to a suitable replacement property. If our efforts fail, we will immediately issue you the refund, which will include an extra 5% of your booking's total (minus taxes) to help make up for the inconvenience.
Liability: Tenant acknowledges that there is no lifeguard or lifeguard service at the property's pool & hot tub facility nor at most Maui beaches, and, therefore, use of the property's pool and hot tub, or the shoreline &/or ocean areas is undertaken at the sole risk and responsibility of the Tenant, or any of the Tenant’s invitees. The Tenants understand that entering and swimming in the pool, hot tub, or ocean can be hazardous under any conditions, and may cause serious bodily injury and, sometimes, death.
Under no circumstances, shall Merry Maui Weddings, Maui Aloha Vacations (including their employees, managers, agents), Sandra L. Furumoto, the property manager, or your agent, be responsible for any loss, expense, damages, claims, injury or death, as a result of allowing entry to the premises, rendering of services and providing of accommodations. Tenant agrees to assume the risk and be responsible for any and all damages, losses and injuries.
Assignability: This Agreement is NOT assignable by the Tenant, nor may Tenant sublease these premises.
