Rental Policy

Age Requirements
The Guest represents to the Agent that either: 1) there is at least one individual who will be an occupant of the vacation rental property during the entire term of this rental agreement who is at least 25 years old: 2) there is a married couple who will be occupants of the vacation rental property during the entire term of this rental agreement where at least one of the individuals is 21 years of age. Additionally, the individual signing this rental agreement (referred to as the "signing lessee" in Paragraph 7) represents to the Agent that he/she will be an occupant of the vacation rental property during the entire term of this rental agreement and that he/she meets the aforementioned age requirements.

Cancellation Policy
Cancellation of a reservation less than 60 days prior to arrival date will result in the loss of all funds unless we are able to rebook the property for the same rate and dates. If reservations are cancelled prior to the 60-day cancellation, guest will be charged the booking fee and $100 cancellation fee. All cancellations are subject to administrative fees. Any changes in properties or dates must occur 60 days prior to arrival.

Check-In Time
CHECK-IN TIME IS 4pm. Plan to arrive in your villa no earlier than 4pm. Do not use the house pool/spa before 4pm on the check-in day. WE MAKE EVERY EFFORT TO ENSURE YOUR VILLA IS READY AT 4PM, BUT WE CANNOT GUARANTEE THIS.

Check-Out Time
CHECK-OUT TIME IS 10AM This is a must due to logistics of turnover. Keys must be put back in the lockbox upon departure.

Damage
Damage must be reported by the guest before departure. Guest will be responsible for expenses incurred. Guest agrees to surrender property in the same condition as at commencement of the rental period. In cases of abuse and malicious damage to rental property, guest will reimburse Agent and/or Owner the amount of all damage including reasonable attorney's fees.

Early Check Out/No Show Policy
THERE WILL BE NO REFUNDS FOR EARLY CHECK OUTS OR NO SHOWS - Guest agrees that once they have checked into the property, no refund will be made for early check outs. If guest does not cancel the reservation and does not arrive for the Guest's rental period, all monies paid will be forfeited.

Fireplaces/Garages
Fireplace and garage use varies from home to home. Most fireplaces are decorative only, and some garages are used for owner storage

General Policies
This agreement constitutes a contract between the guest and HiltonHeadRentals.com-Hilton Head, Agent for the Owner of the property. Please read carefully, sign and return one copy within 10 business days.

Homes/Villas
Neither HiltonHeadRentals.com nor owner shall be responsible for providing any additional furnishings or equipment not available presently in the residence. It is understood that each property and its furnishings are privately owned and HiltonHeadRentals.com acts as the sole Agent for the Owner. Please do not remove items from the property or change the location of furniture that belongs to the rental unit owner. If furniture is moved, you will be responsible for any charges incurred in returning it to its proper location.

Hurricane Policy
PLEASE READ CAREFULLY - Agent will not issue any refunds for hurricane evacuations or any other natural disasters. Agent will only issue refunds for days missed due to MANDATORY evacuation.

Indemnification of Agent by Guest
Guest agrees to indemnify and save Agent, its employees and Agents, free and harmless from any claim or liability for any loss or damage whatsoever arising from, related to or in connection with rental of the vacation rental property, including but not limited to any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by any Guest or any Guest's invitee.

Lost and Found
Lock all doors when you leave your accommodations. Do not leave money or valuables unattended in the unit; neither Agent nor the owner will be held accountable or liable for any thefts. Thoroughly check all drawers and closets before departing. Agent only returns left behind items upon request by UPS or US Postal Service at the Guests' expense.

Occupancy
The Guest agrees not to exceed the maximum occupancy allowed by this property as described on the front of this lease (babies in cribs are not included). Person signing the contract must occupy the premise the entire length of stay. HiltonHeadRentals.com-Hilton Head Island does not rent to minors. [Please see Penalty for Violation of this Agreement as outlined below.]

Penalty for Violation of this Agreement
If Guest violates any of the conditions or restrictions of this agreement, the Guest agrees that the Agent may terminate this agreement and enter the vacation rental property. Upon notice of termination of the agreement, the Guest shall vacate the dwelling immediately without being entitled to any refund and shall waive any rights that may be applicable under South Carolina landlord-tenant act.

Pet Policy
THOSE UNITS NOT SPECIFIED "PET-FRIENDLY" STRICTLY PROHIBIT PETS. UNITS SPECIFIED "PET-FRIENDLY" REQUIRE NOTIFICATION AND APPROVAL, IN ADDITION TO PAYMENT OF REQUIRED PET DEPOSIT, AT THE TIME OF RESERVATION. This policy will be strictly enforced. If you are found in violation of this Policy, the Agent reserves the right to immediately cancel your rental reservation and occupancy of the vacation rental property. Additionally, Guest will forfeit all monies for the balance of their stay and incur a minimum additional penalty of $250.

Prohibited Vehicles
Parking is not allowed on streets. Gated communities do not allow campers, motor homes, motorcycles, boats and boat trailers and recreational vehicles.

Property Availability
In the event that the Owner of the privately owned vacation rental property makes the vacation rental property unavailable, or should the vacation rental property be undergoing any major repairs, Agent shall be held harmless by Guest. Agent will make every effort to move guests to comparable accommodations at the original rate. If comparable accommodations are not available, the guest agrees to accept a full refund of any monies paid.

Rates
All reservations that are made for any future year are not guaranteed. Agreements with the property owners are made in the fall of the current year for the next year. Rates and or the property could change. Guest will be notified if there is a property or rate change by no later than the beginning of the year that their reservation is current. Guest may cancel within a set time period (set by the company) without cancellation penalties if they do not wish to accept the new rate or property. Rates are quoted on a weekly basis. A nightly rate will be 1/5 of the weekly rate. A minimum of three nights is required with all properties. During the Sport and Vacation seasons, rentals are required to be a minimum of a week and from Saturday to Saturday. Nightly rentals will be accepted within a 30 day period of your stay. Please call the office to inquire for nightly rentals during the prime seasons. Company has the right to cancel and not honor any reservation made over the internet that may not fall under these guidelines. Please note: Some owners may require a minimum of a week's stay all year round.

Rental Balance and Signed Contract
Balance of rental monies is due 60 days prior to arrival. Exact date is located next to final balance. While there may be numerous occupants in a given vacation rental property, only the reserving party is required to sign the lease. The agent will hold the signing leasee responsible for the payment and other lease holder responsibilities enumerated in the lease.

Repairs
Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. HiltonHeadRentals.com Hilton Head uses the best maintenance personnel available on the Island. Problems are corrected as soon as humanly possible. Agent or an authorized employee or repairman may enter the premises during business hours for any purpose connected with the repair, care or maintenance of the premises. Refunds will not be issued due to malfunctioning equipment or other guest dissatisfaction. Hilton Head is a highly desirable developing resort area with houses under construction. We do not move people or give refunds due to construction noise. You can expect a courteous and professional attitude toward problem solving.

Return Checks
A $35 service charge will be levied on any returned checks.

Use
Any use of the vacation rental property other than residential use during a family vacation must be approved by the Agent. If the vacation rental property is to be used for any event such as weddings, receptions, "parties" or large gatherings, the Guest agrees to submit a request for approval to the Agent and adhere to the Agent determination on that request. If the Agent approves the event, the Guest may be required to pay an additional deposit. If the Guests misrepresents an event to the Agent (said misrepresentation to be determined by the Agent), the Guest agrees that the Agent may refuse occupancy or have the vacation rental property vacated and that the Guest will not be entitled to any refund.
